These Terms of Service ("Terms") govern your use of the services provided by Fonte Marketing ("Fonte Marketing," "we," "us," or "our"). By engaging our services, purchasing a service, or using this website, you ("you," "the client") agree to these Terms.
1. Services
Fonte Marketing provides digital marketing services for contractors and local service businesses, including:
- Google Ads Management — setup, optimization, and ongoing management of Google Ads campaigns.
- Website Design & Development — design, development, and delivery of business websites.
The specific scope, deliverables, and timeline for your project will be agreed upon before work begins.
2. Fees & Payment
- Websites are offered at a one-time fee of $297 unless a different scope and price is agreed to in writing.
- Google Ads for Contractors is offered on a performance basis. There is no upfront cost and no charge for leads, estimates, or advertising spend. You are charged a flat fee only when we book you a qualified job, based on the job's value: $350 for jobs from $3,500 to $5,000, $500 for jobs from $5,000 to $10,000, and $600 for jobs over $10,000. Jobs under $3,500 are handled on a case-by-case basis. If a booked job falls through, no fee is owed.
- Payments are processed securely through our third-party payment processor, Stripe. Fees are due as agreed at the time of purchase or on the invoice date.
3. Client Responsibilities
To deliver our services effectively, you agree to provide, in a timely manner: business information and content, access to relevant accounts (such as Google Ads, Google Business Profile, or hosting), and timely feedback and approvals. Delays in providing these may affect project timelines.
4. Third-Party Services
Our services rely on third-party platforms including, but not limited to, Google Ads, Google Analytics, website hosting providers, and Stripe. We are not responsible for the availability, policies, pricing, or actions of these third parties. Your use of those platforms is subject to their own terms.
5. Website Ownership & Hosting
Upon receipt of full payment, you own the content and final deliverables of your website. Any hosting, domain registration, or third-party subscription costs are your responsibility unless otherwise agreed in writing.
6. No Guarantee of Results
Marketing outcomes depend on many factors outside our control, including your market, competition, budget, and platform changes. While we work diligently to improve your results, we do not and cannot guarantee specific rankings, lead volume, sales, or return on ad spend.
7. Cancellation & Termination
Our Google Ads service is provided with no long-term contract. You may pause or stop at any time, and you are only ever charged for jobs booked while the service is active. Refunds, where applicable, are governed by our Refund Policy. We reserve the right to suspend or terminate services for non-payment or violation of these Terms.
8. Limitation of Liability
To the fullest extent permitted by law, Fonte Marketing shall not be liable for any indirect, incidental, or consequential damages, or for lost profits or revenue, arising from your use of our services. Our total liability for any claim shall not exceed the amount you paid to us for the service giving rise to the claim.
9. Indemnification
You agree to indemnify and hold harmless Fonte Marketing from any claims, losses, or liabilities arising from content you provide, your products or services, or your violation of these Terms or any third-party rights.
10. Governing Law
These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-law provisions.
11. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.
